1. The Owner is:

and the Owner may also be referred to as "we" and "us".

2. The Guest is the person who signs the booking form or, in the case of an online booking, the person who makes the online payment for/towards the cost of the booking. The Guest may also be referred to as "you" and “your”.

3. The Property is:

4. A contract between the Guest and the Owner will come into existence when your completed and signed booking form or online booking is received by us with the required payment, and written confirmation of acceptance has been sent by the Owner (which may be by email) showing the confirmed dates of your stay. The contract binds you and all members of your party. It is your responsibility to ensure that all members of your party accept and adhere to the terms of the contract set out in these terms & conditions.

5. Failure by you to disclose all relevant information to the Owner at any time, or failure by you to comply with these terms & conditions, may lead to termination of the contract and loss of your booking and any monies paid.

6. Bookings and cancellations

(a) A booking deposit, being 30% of the total cost of your stay, is payable within 2 days of your booking being made. Your booking is taken on a provisional basis until the booking deposit has been paid in full and funds cleared through the banking system (where appropriate). Your booking then becomes confirmed. Until your booking is confirmed, it can be cancelled at any time by you or us without prior notice.

(b) The balance of the cost of your stay, plus a £250 refundable damage/cleaning deposit and full payment for any bookable extras, must be paid no later than 8 weeks before your arrival date. If the balance is not received by that date, your booking will be treated as a cancellation and you will remain liable to pay the balance of the cost of your stay.

(c) Bookings made less than 8 weeks before your arrival date must be paid in full at the time of booking, plus a £250 refundable damage/cleaning deposit and full payment for any bookable extras.

(d) All cancellations must be notified to the Owner by email at walesrivercottage@gmail.com. You must have confirmation of receipt by us. If you cancel your booking more than 8 weeks before it is due to start, then your booking deposit will be forfeited and no further balance will be payable. If you cancel less than 8 weeks before your stay is due to start, your booking deposit will be forfeited and the full balance will remain due.

7. Refunds of booking deposits and balancing payments

(a) The following charges apply to all cancellations:

(i) All booking deposits are non-refundable;

(ii) Any booking cancelled more than 8 weeks before your arrival date: 30% of the booking value (taken as a booking deposit at the time of booking);

(iii) Any booking cancelled 8 weeks or less before your arrival date: 100% of the booking value.

(b) In the event of a cancellation, we will use reasonable endeavours to re-let the Property and, if successful, a discretionary refund may be made to you. However, we strongly recommend that you take out comprehensive travel insurance prior to making your booking to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to any cancellation.

(c) Your booking will not be cancelled by the Owner except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible and the Owner will promptly refund all payments made for your stay. The Owner’s liability for cancellation will be limited to payments made by you to the Owner; no compensation or consequential losses shall be paid.

8. Miscellaneous

(a) Whilst every care is taken to provide a true and accurate description of the Property, over time alterations are made and some things do change. The Guest accepts that no refunds are available for such discrepancies.

(b) The Owner reserves the right to terminate your stay without refund or compensation where your behaviour may impair the enjoyment, comfort or health of others or where the safety and security of the Property is reasonably considered to be compromised or likely to become compromised or where your behaviour is unreasonable. This includes, but is not limited to, excessive noise emanating from the Property, smoking/vaping on any part of the Property including the garden or other external areas, out-of-control dogs being present, or any behaviour or action which adversely affects or is likely to adversely affect the Property, its fixtures and fittings or its contents.

(c) The Owner reserves the right to refuse a booking without giving any reason.

(d) The Owner reserves the right to enter the Property at any reasonable time on reasonable notice (or at any time without notice in an emergency) to undertake essential maintenance or for inspection, or for any other reasonable purpose. Where possible, the Owner will respect your right to privacy and confidentiality and accommodate any reasonable request as to timing or other arrangements.

(e) Please do not move any furniture from one room to another.

(f) Please lock the front door and close the windows when you leave the Property unoccupied.

(g) Please do not take any towels, blankets, throws, cushions or any other items outside of the Property (please provide your own beach towels for use in the garden or elsewhere).

(h) Smoking or vaping is not permitted anywhere on the Property (including outside), and please do not use BBQs, candles or tealights anywhere as this will invalidate our insurance.

(i) You are required to read and understand the ‘Guest Information pack’ which will be sent to you prior to the start of your stay. A copy will also be available in the Property on arrival. If you have any queries please raise these with the Owner at the earliest opportunity. You will be expected to follow the instructions and guidance therein and, in particular, please note the instructions for using the wood burning stove.

9. Occupants

(a) The maximum number of persons using the Property at any time must not exceed two persons and only those listed on the booking form (or as part of the online booking process) can occupy the Property. The full names of all those occupying the Property must be provided. No babies or children or any persons under eighteen years of age are permitted to stay at the Property. The Owner reserves the right to terminate your booking without notice and without refund in the event that this condition is breached.

(b) The Property contains only 1 x king size bed which is located in the Property’s only bedroom; no additional beds will be provided and no alternative sleeping arrangements or configurations will be considered.

(c) Bookings cannot be accepted from persons under eighteen years of age.

(d) You may under no circumstances re-let or sublet the Property, even free of charge.

10. Arrival and departure

(a) Bookings commence at 4pm on the first day of your stay unless otherwise agreed in advance with the Owner, and guests are required to vacate the property by 10am on the day of departure. This allows the Property to be thoroughly cleaned and prepared for you or other guests. Every effort will be made to have the Property available from 4pm on the day of arrival.

(b) Early arrival or late departure will result in an additional charge being made or part of the damage/cleaning deposit being retained.

(c) Our ‘Guest Information pack’, which includes directions to the Property and information about the collection of keys, will be provided once full payment has been received from you, usually 1-2 weeks before your stay.

11. Pets

Only well-behaved dogs are allowed at the Property and please note the following:

o Only one large/medium sized dog or two small dogs are allowed at the Property at any time, by prior arrangement only with the Owner.

o Dogs are not allowed on any furniture and are not allowed upstairs in the Property.

o Dogs must not be left unaccompanied in or around the Property at any time.

o Dogs must be declared on the booking form (or as part of the online booking process).

o Guests are responsible for cleaning up after their dogs.

o An additional non-refundable charge for cleaning costs of £35 may be payable prior to your stay, at the Owner’s discretion.

o Your dogs are your responsibility. The Owner accepts no responsibility for dogs brought to the Property.

o Please be aware that the garden at the Property is not fully secure, due to the natural landscape, and there is (sometimes) fast-flowing water running through and adjacent to the garden. Additionally, the garden is planted with many varieties of plants, some of which may be harmful to dogs.

o Dogs should be kept on a lead and/or closely supervised at all times whilst outside, as the Property is in a rural, farming area with sheep and cattle in neighbouring fields.

12. Wood burning stove

The Property has the benefit of a wood burning stove, which is available for use between October and April, but if you are staying during the spring/summer months and would like to use the stove, please let us know. If you are wishing to use the stove between May and September, please note that it may be out of action from time to time for maintenance, and there may be a fee payable for the provision of logs and kindling.

Note that the stove is not necessary for warmth, as the cottage has full central heating.

INSTRUCTIONS FOR HOW TO USE THE STOVE ARE IN THE COTTAGE. PLEASE READ THE INSTRUCTIONS BEFORE USING THE STOVE.

If you do not follow the instructions provided, and extra cleaning, maintenance or replacement of the stove or chimney is required as a result of your actions, then you may be liable for any costs incurred by us for putting things right.

13. Electric vehicle charging

Until such time as we have installed an electric vehicle charging facility, the charging of any electric vehicle at the Property is strictly prohibited. If an electric vehicle has been charged at the Property you will be asked to leave the Property immediately without any refund or compensation and forfeiting the damage/cleaning deposit.

14. Damage/cleaning deposit

(a) The Property is privately owned and is part of the Owner’s home. Please therefore treat the Property with the same respect you would your own home and leave it in a clean and tidy condition on your departure.

(b) By making a booking you accept responsibility for any theft, breakage or damage caused by you, your dogs or any member of your party to the Property (fair wear and tear excepted) and you agree to indemnify the Owner in full for any loss that the Owner may incur as a result of any act or omission by you, your dogs or any member of your party. A damage/cleaning deposit of £250 is required to be paid before your arrival date and will be returned to you within 7 days of the end of your stay, less the cost of any damage, breakages, missing items or additional cleaning that may be required.

(c) Please treat the Property, fixtures and fittings and contents with due care so that you and other guests may continue to enjoy them. If you notice something is missing or damaged, please let the Owner know immediately so that appropriate action can be taken. If there has been any damage, loss or breakage during your stay, please report the same promptly and before your departure. The Property will be inspected at the end of your stay and you may be charged for any damage, loss or breakage. The Owner reserves the right to make a charge to cover additional cleaning costs if you leave the Property in an unacceptable condition.

(d) Please note that if any keys issued are not returned by you at the end of your stay then the cost of replacement will be charged to you.

15. Liability

(a) The Owner shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance at the Property.

(b) No compensation will be given for any temporary outage of electricity, water, internet connection or television service or for the unavailability of any goods or services, such as the wood burning stove, during your stay.

(c) The Owner is not responsible for the loss of or damage to any of your personal belongings or valuables, including your vehicle(s). Your personal belongings or valuables (including your vehicle(s)) at the Property are kept at your own risk.

(d) Due to the nature of the Property (inside and outside) there are uneven steps and surfaces, low beams, sloping grounds, and open watercourses. Please take care. We accept no liability for accidents or falls.

(e) Every effort has been made to describe the Property fairly. All information provided is given in good faith and is correct at the time of publication.

(f) The Owner reserves the right to make reasonable amendments or additions to these terms & conditions without notice.

16. Complaints

Every endeavour is made to ensure your stay with us is memorable for all the right reasons! However, we do recognise that from to time things may go wrong. Any problem or complaint you may have concerning your stay must be immediately reported directly to the Owner, who will endeavour to put matters right. Any complaints not reported to the Owner at the time and only reported after your stay has ended will not be considered by the Owner.
